Terms and Conditions of Use

Welcome to www.ebtpr.com and/or the Contigo EBT service (the “Service”). By using the Service, you agree to the following Terms and Conditions of Use (the “Terms and Conditions”). Please read these Terms and Conditions carefully prior to using the Service as these constitute an agreement between the parties and will govern our relationship in terms of the applicable rights and obligations.

Definitions. References to “you” mean you as the Service user. References to “we,” “us,” and “our” mean Evertec. The terms in these Terms and Conditions will be defined as set forth below, except for terms that are clearly understood in context.

“App” means the Contigo EBT application for iOS or Android, available free of charge through the Apple App Store or Google Play, respectively.
“Device” means the mobile phone, personal tablet, computer, or other equipment through which the user makes use of the Service.
“Evertec” means Evertec Group, LLC, a limited liability company that operates and owns the Contigo EBT app and service, with headquarters in Carr. 176 Km. 1.5, San Juan, Puerto Rico.
“EBT Card” means the user's Electronic Benefit Transfer (EBT) card issued in the Commonwealth of Puerto Rico that is registered with the Service. It includes and is limited to: Family Card, Única Card, Workers’ Compensation Card, and the card from the Department of Education.
“www.ebtpr.com” means the web portal of the Contigo EBT service operated by Evertec.

Service Description

Through the APP

The Service lets you view the following information for your Puerto Rico EBT Card: (i) current balance, (ii) next benefit payment authorized by the applicable agency, and (iii) date range and transaction history for the last 180 days, as applicable.
The Service is available in Puerto Rico to individuals 18 years of age or older.

Through www.ebtpr.com:

The Service lets you:

View the following information for your EBT Card: (i) current balance, (ii) next benefit payment authorized by the applicable agency, and (iii) transaction history for the last 180 days.
View the following information for your Puerto Rico EBT Direct Deposit service: (i) pending deposits to be sent to the bank and (ii) the history of bank deposits sent over the last 180 days.
View the following information for your Puerto Rico EBT Direct Payment service: (i) pending payments to be sent to the utility company and (ii) the history of payments sent to the utility company over the last 180 days.

The Service is available in Puerto Rico to individuals 18 years of age or older.

Eligibility

Requirements through the APP:

To be eligible to sign up for the Service, you need to meet the following requirements:

Have an EBT Card
Have an email address with storage to receive messages
Be at least 18 years old
Have a mobile phone with the following:

iOS (iPhone 6s and up) with operating system iOS 15.2 or higher, or ARM Android with operating system Android Nougat (v7.1) or higher.
set up with standard internet connectivity with your network operator (e.g., GPRS, 3G, 4G, 5G, or LTE) or with Wi-Fi connectivity capability

Have access to a device with internet service

Have Direct Payment with EBT
Have access to a device with internet service

Registration Process

How to Sign Up

Through the APP: To register for the Service, you must first download the Contigo EBT application, available through the Apple App Store or Google Play. You will need to go to the app and follow the steps provided in order to complete your Service registration. Make sure that the information provided to register, including your personal and EBT Card information, is complete and correct.

Through www.ebtpr.com: To register for the Service, you must first go to www.ebtpr.com. You will need to go to www.ebtpr.com and follow the steps provided in order to complete your Service registration. Make sure that the information provided to register, including your personal data and information about your EBT Card or your EBT Direct Deposit or Direct Payment service, is complete and correct.

Personal Information and Security Code

Through the APP: As part of registration process, you will need to: (1) Provide the following information:

First and last name
Email (this will be your username)
EBT Card number
Passcode or PIN corresponding to the EBT Card (for security purposes, if you enter an incorrect PIN 4 times in a row, you will not be able to complete the registration process until after 24 hours have elapsed since the last time you submitted an incorrect PIN)
Fill in the security code (CAPTCHA) in the specified field.

(2) Submit the security code that you will receive at the email address provided (confirmation codes expire after 15 minutes from receipt). For security purposes, if you submit an incorrect code 3 times in a row, you will need to wait 30 minutes to continue the registration process. If you submit an incorrect code 4 times in a row, you will not be able to complete the process until the day after the last time you entered an incorrect code.

Through www.ebtpr.com: As part of registration process, you will need to: (1) Provide the following information:

First and last name
Email (this will be your username)
Information about your EBT service:
- Signing up with EBT Card: EBT Card number, Passcode or PIN corresponding to the EBT Card (for security purposes, if you enter an incorrect PIN 4 times in a row, you will not be able to complete the registration process until after 24 hours have elapsed since the last time you submitted an incorrect PIN).
- Fill in the security code (CAPTCHA) in the specified field.
- Signing up with EBT Direct Deposit: Bank account number, Social Security number, bank name, bank routing number, agency
- Signing up with EBT Direct Payment: Utility account number, Social Security number, utility company, agency

Password

Through the APP: As part of the registration process, you will be asked to choose a password to be entered every time you want to access the Service. The password must have: (i) 8 to 16 characters, (ii) at least 1 digit, (iii) at least 1 special character, and (iv) at least one capital letter. You will be responsible for protecting your password's confidentiality and not disclosing it to anyone. If you forget your password, you can reset it through the app or www.ebtpr.com.

Through www.ebtpr.com: As part of the registration process, you will be asked to choose a password to be entered every time you want to access the Service. Security Code

Through the APP: As part of the registration process, you will need to submit a security code that you will receive at the email address provided. The security code will help us confirm whether you are the person requesting access to your Service profile. If you locked or forgot your password, the security code is used as part of the password reset process. For security purposes, the code will expire after 15 minutes. If you submit an incorrect code 3 times in a row, you will need to wait 30 minutes before continuing the process. If you submit an incorrect code 4 times in a row, you will not be able to complete the process until the day after the last time you submitted an incorrect code.

Through www.ebtpr.com: As part of the registration process, you will need to submit a security code that you will receive at the email address provided. The security code will help us confirm whether you are the person requesting access to your Service profile. If you locked or forgot your password, the security code is used as part of the password reset process. For security purposes, the code will expire after 15 minutes. If you submit an incorrect code 3 times in a row, you will need to wait 30 minutes before continuing the process. If you submit an incorrect code 4 times in a row, you will not be able to complete the process until the day after the last time you submitted an incorrect code.

Handling Your Information

Through the APP: In order to register for the Service, you will need to provide certain personal information, including, but not necessarily limited to, your name, email address, and the PIN and number of your EBT Card. For security purposes, you will not be able to update this information in the course of your use of the Service. You agree to provide only true and accurate information in the registration process and during your use of the Service. By providing us with your email address, you consent to us contacting you by email regarding matters related to the Service. The manner in which your data is handled will be governed by these Terms and Conditions and by Evertec's Privacy Policy.

Through www.ebtpr.com: In order to register for the Service, you will need to provide certain personal information, including, but not necessarily limited to, your name, email address, the PIN and number of your EBT Card, Social Security number, bank account number, and utility account number. For security purposes, you will not be able to update this information in the course of your use of the Service. You agree to provide only true and accurate information in the registration process and during your use of the Service. By providing us with your email address, you consent to us contacting you by email regarding matters related to the Service. The manner in which your data is handled will be governed by these Terms and Conditions and by Evertec's Privacy Policy.

Registration and Data Validation

Through the APP: You authorize us to search or consult, directly or through a third party, all information necessary to validate your registration and authenticate your identity and EBT Card. We will validate: (i) your email, using a code sent to the email address provided in the registration process, and (ii) your EBT Card, using your card's information and PIN.

Through www.ebtpr.com: You authorize us to search or consult, directly or through a third party, all information necessary to validate your registration and authenticate your identity and EBT Card. We will validate: (i) your email, using a code sent to the email address provided in the registration process, (ii) your EBT Card, using your card's information and PIN, (iii) your EBT Direct Deposit service, using your bank account information, and (iv) your EBT Direct Payment service, using your utility account information.

Access Recovery Process

Through the APP: If you are already registered but have problems accessing the Service because you locked your password or forgot your password or username (the username will always be the email address you submitted to sign up for the Service), please follow the instructions in the app's login screen. To reset your password, you will need to submit a security code that will be sent to your registered email address. If you fail the authentication tests to reset your password 3 consecutive times, you will need to wait 30 minutes before you can try again. After the fourth failed attempt, you will need to wait until the next day.

To avoid forgetting your email address, you may also activate the “Remember Email” option in the login screen. The next time you log in, the email field will be automatically populated with the data provided.

Through www.ebtpr.com: If you are already registered but have problems accessing the Service because you locked your password or forgot your password or username (the username will always be the email address you submitted to sign up for the Service), please follow the instructions in the login screen at www.ebtpr.com. To reset your password, you will need to submit a security code that will be sent to your registered email address. Your Obligations

Your Information and Profile

You hereby state that you are the legal owner of the EBT Card and any other personal information you provide when registering for the Service. You acknowledge and agree that all information you provide to us in connection with the Service is accurate, current and complete, and that you have the right to provide such information to us in order to use the Service. You agree not to misrepresent your identity or your EBT Card information. You also affirm that you are an authorized user of the Device you will use to access the Service.

Your Profile Security

You agree not to share or give others access to your password or other personal information in order to access the Service. If you allow others to use your password, Device, or other methods to access the Service, you will be responsible for any activities carried out by them.

User Conduct

You agree to use the Service for lawful purposes. You agree not to use the Service in a way that: (i) is unlawful or violates any applicable law, statute, ordinance, or regulation; (ii) interferes with or disrupts the computer networks connected to the Service; (iii) interferes with or disrupts Service use by any other user; (iv) facilitates unauthorized entry into or access to another person's computer system; or (v) encourages conducts that may constitute a criminal offense or give rise to civil or criminal liability.

No Resale

The resale, lease, rental or distribution of the Service to any third party is prohibited.

Equipment

You will be responsible for obtaining and providing maintenance for the mobile device, computer, or other equipment required to access and use the Service, and for any charges associated to such equipment.

Service Availability

The service is generally available 24/7, 365 days a year, except during Service maintenance periods and under circumstances beyond our control, or if you are in an area with limited mobile network coverage or Internet access. You will only be able to access the Service from the territories and associated states of the United States of America. Accessing the Service from abroad may result in charges unrelated to the Service, such as roaming or mobile network fees levied by your phone service provider. These charges may vary depending on the country where you are. In some instances, accessing the Service from abroad may be prohibited by law.

Applicable Fees

There are currently no charges applicable to the Service. Use of the Service from your Device may be subject to certain taxes and fees from your phone or internet service provider, which would be payable directly to said provider. Please contact your phone service provider to learn more about such fees, if any.

Relation to Other Agreements

By using the Service, you agree and acknowledge that the use of your EBT Card is governed by the applicable government agency, which determines who qualifies as an EBT Card beneficiary. Evertec has no involvement in, and is not responsible for, the determination of applicable EBT Card benefits or the eligibility of its beneficiaries.

Service Limitations

The availability of some of your EBT Card information in the Service is entirely contingent on the government agency that manages the EBT Card making it available. On the other hand, Service availability, timeliness, and performance depend on many factors, including the location of your Device, the availability and signal strength of the wireless network, and the operation and configuration of the hardware and software. Neither Evertec nor any of our service providers warrant that the service will adapt to your needs, operate without interruption, or be free of defects. Neither Evertec, nor any of our service providers, will be liable for any loss or damage caused by a downtime or malfunction of the Service or for any actions taken in that regard, for any reason including Service interruptions, delays, inaccuracies, loss of data, or loss of customized settings. Neither Evertec, nor our service providers, will be liable for your failure to fulfill your obligations under these Terms and Conditions as a result of a natural event or an act beyond our control; or of any failure or delay in transportation, power, computer, or telecommunications systems; or for any other cause beyond our control.

Termination of Service

You may terminate your participation in the Service at any time by accessing the Delete Profile link after logging in. The Delete Profile link is available in the Settings menu of the application or the Utilities menu of the portal. If you do not have access to the service, you can request termination by contacting the phone on the back of your EBT Card or writing an email to ebtadmin@evertecinc.com. Even if you terminate your participation in the Service, you remain liable for all of your obligations relating to the Service prior to termination. We reserve the right to cancel the Service and/or App at any time. We may terminate or temporarily suspend your access to the Service at any time without notice, either as a security precaution or due to your failure to comply with these Terms and Conditions. You hereby agree that we will not be liable to you nor to any third party for changes to the Service or for its termination.

Changes to the Terms and Conditions

We reserve the right to update, change, and modify these Terms and Conditions or introduce new conditions at any time. All updates, changes, modifications, additions, or deletions will be effective immediately upon notice, which will be published on www.ebtpr.com and in the App and and you will be notified by email or any other means by which you are informed of such changes. If we modify the Service, you will be responsible for making sure you understand how to use the Service as modified. Any use of the Service after such notice will be deemed to be your acceptance of the notified changes, modifications or additions. We reserve the right to change or discontinue, at any given time, any aspect or element of the Service, including, but not limited to, content, hours of availability, and equipment necessary to access or use it.

USE OF THE SERVICE IS AT YOUR OWN RISK

YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE AND OF WWW.EBTPR.COM IS VOLUNTARY AND AT YOUR OWN RISK, AND YOU ACKNOWLEDGE THAT THERE ARE OTHER MEANS BY WHICH YOU MAY OBTAIN INFORMATION ABOUT YOUR EBT CARD. YOU WILL BE RESPONSIBLE FOR PROTECTING THE CONFIDENTIALITY OF YOUR PASSWORD AND WILL BE HELD ACCOUNTABLE FOR ALL ACTIVITIES CARRIED OUT FROM YOUR SERVICE PROFILE. NEITHER EVERTEC NOR OUR AFFILIATES OR RESPECTIVE EMPLOYEES, OFFICIALS, SHAREHOLDERS, AGENTS, SERVICE PROVIDERS, OR LICENSORS GUARANTEE THAT THE APP OR WWW.EBTPR.COM WILL OPERATE UNINTERRUPTEDLY OR BE FREE OF ERRORS. WE ALSO MAKE NO GUARANTEES AS TO THE OUTCOMES THE USER MAY OBTAIN FROM USING THE SERVICE OR AS TO THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION, SERVICE, OR GOODS PROVIDED THROUGH THE APP OR WWW.EBTPR.COM.

NO WARRANTY

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED OR WHICH MAY NOT BE EXCLUDED, LIMITED, OR MODIFIED UNDER APPLICABLE LAW. NEITHER EVERTEC NOR ITS AFFILIATES OR ANY OF THEIR RESPECTIVE EMPLOYEES, SHAREHOLDERS, AGENTS, THIRD-PARTY SERVICE PROVIDERS OR LICENSORS, WARRANT THAT THE SERVICE WILL OPERATE UNINTERRUPTED OR ERROR-FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, INCLUDING THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION OR FEATURES PROVIDED THROUGH THE SERVICE.

LIMITATIONS ON LIABILITY AND INDEMNITY

UNDER NO CIRCUMSTANCE SHALL WE OR ANY OTHER PERSON OR ENTITY PARTICIPATING IN THE CREATION, PRODUCTION, OR DISTRIBUTION OF THE SERVICE BE LIABLE FOR ANY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR ACCESS OR USE OF THE SERVICE OR FROM YOUR INABILITY TO USE THE SERVICE. AS A USER OF THE SERVICE, YOU AGREE AND ACKNOWLEDGE THAT THE PROVISIONS IN THIS SECTION APPLY TO ALL CONTENT IN THE APP AND IN WWW.EBTPR.COM. UNDER NO CIRCUMSTANCES SHALL WE OR ANY OTHER PERSON OR ENTITY INVOLVED IN THE CREATION, PRODUCTION, OR DISTRIBUTION OF THE SERVICE BE LIABLE FOR ANY ERRORS, OMISSIONS, OR OTHER DEFECTS IN THE INFORMATION OR CONTENT IN THE APP OR ON WWW.EBTPR.COM, OR FOR DELAYS OR INTERRUPTIONS IN TRANSMISSIONS TO ANOTHER USER (REGARDLESS OF THE CAUSE OR DURATION), OR FOR ANY CLAIMS OR LOSSES ARISING AS A RESULT OF SUCH ERRORS, OMISSIONS, DEFECTS, DELAYS, OR INTERRUPTIONS. THIS NO-LIABILITY DISCLAIMER APPLIES TO ANY INJURY OR DAMAGE CAUSED BY NON-COMPLIANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAYED OPERATION OR TRANSMISSION, CYBER VIRUS, TRANSMISSION LINE MALFUNCTION, THEFT OR DESTRUCTION, OR UNAUTHORIZED ACCESS, WHETHER FOR BREACH OF CONTRACT, TORTIOUS CONDUCT, NEGLIGENCE, OR ANY OTHER CAUSE OF ACTION. YOU AGREE TO DEFEND, HOLD HARMLESS, AND INDEMNIFY EVERTEC AND THEIR RESPECTIVE AFFILIATES AND DIRECTORS, OFFICERS, SHAREHOLDERS, EMPLOYEES, AGENTS, AND ASSIGNEES FROM ALL CLAIMS AND EXPENSES, INCLUDING ATTORNEYS' FEES, ARISING FROM YOUR USE OF THE SERVICE OR FROM YOUR VIOLATION OF THESE TERMS AND CONDITIONS, EXCEPT WHERE SUCH CLAIM OR EXPENSE WAS CAUSED BY GROSS NEGLIGENCE OR WILLFUL ILLEGAL CONDUCT OF THE PARTY TO BE DEFENDED, HELD HARMLESS, AND/OR INDEMNIFIED.

Intellectual Property Rights

You may use the content provided through the App and www.ebtpr.com only in conjunction with your use of the Service. Any modification, publication, transmission, participation in the transfer or sale, creation of derivative works, or exploitation in any way of the technology used in the Service is prohibited, including, but not limited to, any applications or software associated with the Service. Both the App and www.ebtpr.com contain copyrighted material, registered trademarks or other proprietary information, some of which is owned by Evertec and some of which is owned by third parties. All the content in the App and in www.ebtpr.com has been copyrighted as collective work. Evertec may modify, withdraw, or deny access to the App or to www.ebtpr.com at any time or enforce other access restrictions. Contigo EBT and its logos and designs are service marks of Evertec, and all rights to them are reserved. Any other trademarks or logos shown in the App or on www.ebtpr.com are the property of their respective owners, and their unauthorized use by third parties is prohibited.

The App and www.ebtpr.com may contain links to other websites that are not under our control. We are not responsible for these sites and do not endorse them. You are responsible for reviewing the terms and conditions and the privacy policy of any other website you visit. We are committed to providing you with quality online services. If you find information you deem inaccurate in the App or at www.ebtpr.com, or if you have concerns about a link to a third-party website, please contact us by email.

Content of the Service and www.ebtpr.com

All opinions, advice, statements, services, offers, or other information or content expressed or displayed by third parties (including information providers) on the App or in www.ebtpr.com belong to their respective authors or distributors and not to us. Neither we, nor our agents, nor any third-party information providers guarantee the content's accuracy, correctness, or usefulness for marketing purposes or its fitness for a specific purpose. We do not endorse and are not responsible for the accuracy or reliability of any opinion, advice, or statement made regarding the Service or published in the App or in www.ebtpr.com by any person other than our corporate spokespersons acting in their official capacity.

Entirety of Agreement

These Terms and Conditions constitute the entire agreement between the parties and supersede any prior verbal or written agreements between the parties pertaining to the use of the Service.

Governing Law and Jurisdiction

These Terms and Conditions shall be interpreted in accordance with the laws of the Commonwealth of Puerto Rico, notwithstanding any rules on conflict of laws. All causes of action of any kind arising from these Terms and Conditions will be filed in the Commonwealth of Puerto Rico.
